The Supreme Court Decision Overturning the IEEPA Tariff: Implications for Western Agricultural Producers, Importers and Retailers
The February 10 Supreme Court decision has left many surprised with the rare repudiation of Presidential action. In overturning the IEEPA tariff, the Court has raised significant questions for agricultural producers, importers and retailers.
This webinar will break down what the ruling means in practical terms, including whether there will be refunds of the 12 to 14 billion dollars in duties collected, how much interest is payable with refunds and the process for filing claims. We will also examine the Administration's immediate use of Section 122 of the Tariff Act of 1974 to impose a new 15% tariff, including which agricultural products may be exempt.
Attendees will gain insight into how this decision may affect recently negotiated trade deals and what it signals about the future use of tariffs as a trade policy tool.

Stephen has represented general contractors, subcontractors and property owners in construction litigation, including issues involving subrogation and indemnification. Stephen also has defended individual and class actions brought under various consumer protection statutes, including the Telephone Consumer Protection Act (TCPA), Fair Debt Collection Practices Act (FDCPA) and California’s Invasion of Privacy Act (CIPA). He has also prepared numerous articles and delivered many presentations for trade associations on successfully defending consumer protection litigation.

Leslie Alan Glick (Les) is a Director in Fennemore’s Business & Finance practice group, based in Washington, D.C., and focusing on international trade and customs law, representing clients before the U.S. International Trade Commission, Department of Commerce, Office of the U.S. Trade Representative, and the Court of International Trade. He has extensive experience with antidumping and countervailing duty cases, as well as investigations under Sections 232 and 337 of U.S. trade law. He has handled complex tariff matters for many exporters, importers, and retailers for many years, including the first Trump administration, where he obtained exclusions from section 232 and 301 tariffs for many companies. During the current administration, he has been widely consulted for his ability to develop “tariff mitigation” strategies and has been a frequent speaker before various trade associations.
